Trump urges Garland to prevent Jack Smith from publishing final report.
President-elect Donald Trump and his two co-defendants in the classified documents case are taking legal steps to prevent special counsel Jack Smith from releasing his final report, which reviews both classified documents and Trump’s alleged attempts to block the transfer of power following the 2020 election.
The motion, filed late Monday on the fourth anniversary of the January 6, 2021, Capitol attack, asks Judge Aileen Cannon to stop Smith from publishing the two-volume report.
In a letter accompanying the motion, Trump’s legal team urged Attorney General Merrick Garland to fire Smith and allow the decision regarding the report’s release to be made by the incoming attorney general under the president-elect's administration.
Attorneys for Trump’s co-defendants, Walt Nauta, his valet, and Carlos de Oliveira, a property manager at Mar-a-Lago, cite a previous ruling from Judge Cannon that determined Smith’s appointment as special counsel was unlawful. They argue that this disqualifies Smith from releasing the report.
“The Final Report relies on materials to which Smith, as disqualified special counsel, is no longer entitled access — making his attempt to share such materials with the public highly improper,” the motion states.
Smith’s team filed a response early Tuesday, promising a more comprehensive reply later in the day. “The Department can commit that the Attorney General will not release that volume to the public, if he does at all, before Friday, January 10, 2025, at 10:00 a.m.,” Smith’s filing stated, coinciding with the day Trump is scheduled for sentencing in his New York hush money case.
Smith’s team is appealing Judge Cannon’s ruling that dismissed the case against Trump, Nauta, and de Oliveira, challenging the unprecedented interpretation of special counsel law. However, with the case currently before the 11th Circuit, Cannon’s authority to act remains uncertain.
While the charges against Trump were withdrawn due to Justice Department policies barring criminal indictments against sitting presidents, the case remains active for the other defendants.
In their letter to Garland, Trump’s legal team criticized the draft report, stating, “The Draft Report violates fundamental norms regarding the presumption of innocence, including with respect to third parties unnecessarily impugned by Smith’s false claims. Releasing the report to the public without significant redactions (that would render its release meaningless) would violate prohibitions on extrajudicial statements by prosecutors.”
